Prosecutor Reports On Court Cases

Appearing on Feb. 1

The following defendants appeared in the Superior Court of Klickitat County on on Feb. 1, 2010:

Larry Leon Jorgenson, 56, of Lyle, was convicted after a jury trial of assault in the second degree -- domestic violence, harassment -- domestic violence, and tampering with a witness. The defendant was sentenced to 14 months in prison and must pay all standard court costs including restitution to the victim. The defendant may not have contact with the victim for 10 years. The defendant will be under the supervision of the Department of Corrections for 12 months upon his release from custody.

Dusty David Herberholz, 18, of Goldendale, pled guilty to four counts of burglary in the second degree and was sentenced to 57 months in prison. The defendant must pay all standard court costs totaling $1,770 including $250 to the Goldendale Police Department Investigation Fund and $500 incarceration costs. The defendant must also pay full restitution to all of the victims which include Allyn's Building Center, the Goldendale Swimming Pool, Goldendale Little League, Finer Things, The General Store, the Goldendale Liquor Store, Father's Fellowship Church, and Little Chalet Car Wash in amounts to be determined at later hearings. The defendant cannot have any contact with those businesses for 10 years.

Jacob Dean Farrell, 25, of White Salmon, pled guilty to two counts of burglary in the second degree and was sentenced to 60 months in prison. The defendant must pay all standard court costs totaling $3,230 including $500 to the Bingen-White Salmon Police Department Investigation Fund and $500 incarceration costs. The defendant must also pay restitution to six separate victims in amounts to be determined at later hearings and may not have contact with those victims for 10 years.

David Stewart France, 45, of Wishram, pled guilty to theft in the first degree and was sentenced to two months in the county jail. The defendant must pay all standard court costs totaling $1,850 including $250 to the Sheriff's Office Investigation Fund and $500 incarceration costs. The defendant must also pay restitution to the victim in an amount to be determined at a later hearing and cannot have contact with the victim for 10 years.

David Anthony Burkhart, Jr., 35, of Washougal, pled guilty to assault in the fourth degree with sexual motivation and was sentenced to 4 days in jail. The defendant must pay all standard court costs totaling $950 including $250 to the Goldendale Police Department Investigation Fund. The defendant must pay restitution to the victim in an amount to be determined at a later hearing which will also include all future medical expenses. The defendant is to be supervised by the Department of Corrections for 24 months and must undergo a sexual deviancy evaluation and any recommended treatment in that time. The defendant may not have any contact with the victim for two years.

Joshua Jay Christensen, 20, of Goldendale, pled guilty to assault in the fourth degree and disorderly conduct and was sentenced to 11 days in the county jail and 19 days of service on the county work crew. The defendant must pay all standard court costs totaling $1,877.50 including $250 to the Goldendale Police Department Investigation Fund and $500 incarceration costs. The defendant will be supervised by the Department of Corrections for 12 months and during that time he must undergo evaluations for domestic violence and substance abuse and abide by any recommended treatment.

The following juveniles appeared in the Superior Court on Jan. 28, 2010:

A 15 year old male from White Salmon pled guilty to theft in the third degree and was sentenced to 16 hours of community service and four months supervision by the Juvenile Department. The juvenile must pay standard court costs totaling $175.

A 16 year old male from Goldendale pled guilty to possession of stolen property in the third degree and was sentenced to 16 hours of community service and six months supervision by the Juvenile Department. The juvenile must pay standard court costs totaling $175 including restitution to the victim in an amount to be determined at a later hearing.
